Terms of Service — SongCraft

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Heijnes Digital (KvK 99250926), operating as SongCraft. By accessing or using the SongCraft mobile application, website, or any related services (collectively, the "Service"), you agree to be bound by these Terms.

If you do not agree with any part of these Terms, you must not use the Service.

2. Service Description

SongCraft is an AI-powered song generation service that allows users to create personalized songs. The Service includes:

  • Creating personalized songs using AI-generated lyrics and music
  • Five song modes: Roast Battle, Love Song, Birthday, Breakup, and Hype
  • Eight music styles: Pop, Rap, Rock, Country, R&B, EDM, Acoustic, and Reggaeton
  • Sharing songs with others via unique links
  • Roast Battle challenges between friends
  • Song library management

3. User Accounts

To use certain features of the Service, you must create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Providing accurate and complete registration information
  • Notifying us immediately of any unauthorized use of your account

You must be at least 13 years old to create an account and use the Service.

4. User Responsibilities & Content Rules

When using SongCraft, you agree not to create songs or provide descriptions that:

  • Contain hate speech, threats, or incitement to violence
  • Harass, bully, or target individuals with malicious intent
  • Impersonate real public figures in a misleading or defamatory way
  • Contain sexually explicit content involving minors
  • Promote illegal activities or substance abuse
  • Violate the intellectual property rights of others (e.g., copying existing song lyrics)
  • Contain personal data of others without their consent (e.g., addresses, phone numbers)
  • Attempt to circumvent content moderation systems

We reserve the right to remove any content and suspend or terminate accounts that violate these rules, without prior notice or refund.

5. Intellectual Property

5.1 Your Content

You retain all rights to the descriptions and personal information you provide to create songs. By submitting content to SongCraft, you grant us a limited, non-exclusive license to process your descriptions for the purpose of generating songs.

5.2 AI-Generated Content

Songs generated by SongCraft (including lyrics and audio) are created using AI and are licensed to you for personal, non-commercial use. You may:

  • Share your songs on social media and messaging platforms
  • Use your songs for personal entertainment
  • Keep and download your songs (based on your plan)

You may not use AI-generated songs for commercial purposes (advertising, monetized content, etc.) without prior written consent from Heijnes Digital.

5.3 Our Intellectual Property

The SongCraft name, logo, app design, website, and underlying technology are owned by Heijnes Digital and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our Service.

6. Payments & Subscriptions

6.1 Pricing

SongCraft offers free and paid tiers. Paid options include individual song purchases (Basic, Premium, HD), song bundles, and a Pro weekly subscription. Current pricing is displayed in the app and on our website.

6.2 Payment Processing

Payments on mobile devices are processed through RevenueCat via the Apple App Store and Google Play Store. Web payments are processed through Stripe. We do not directly store your payment information.

6.3 Subscriptions

The Pro subscription is billed weekly. It includes a 3-day free trial. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can cancel your subscription through your App Store or Google Play settings at any time.

6.4 Refunds

For mobile purchases, refunds are handled by the respective app stores (Apple App Store or Google Play Store) in accordance with their refund policies. For web purchases made through Stripe, refund requests can be submitted to support@heijnesdigital.com within 14 days of purchase. Refunds are evaluated on a case-by-case basis.

7. AI & Content Disclaimers

SongCraft uses artificial intelligence to generate song lyrics and music. You acknowledge and agree that:

  • AI-generated content may not always be accurate, appropriate, or aligned with your intent
  • We employ content moderation but cannot guarantee that all generated content will be free from potentially offensive material
  • Song quality may vary depending on the descriptions provided and the selected style
  • Generation times may vary based on server load and demand
  • We do not guarantee uninterrupted access to AI generation services

8. Limitation of Liability

To the maximum extent permitted by applicable law, Heijnes Digital and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, data, or goodwill
  • Service interruptions or unavailability
  • Offensive or inappropriate AI-generated content
  • Unauthorized access to your account
  • Any other matter relating to the Service

Our total liability for any claims arising from or relating to the Service shall not exceed the amount you have paid us in the 12 months prior to the event giving rise to the claim, or EUR 100, whichever is greater.

9. Termination

We may suspend or terminate your access to the Service immediately, without prior notice or liability, if:

  • You violate these Terms of Service
  • You violate our content rules (Section 4)
  • You engage in fraudulent or abusive behavior
  • Required by law or regulatory authorities

You may terminate your account at any time by deleting it through the app settings or by contacting support@heijnesdigital.com. Upon termination, your data will be deleted in accordance with our Privacy Policy.

10. Indemnification

You agree to indemnify and hold harmless Heijnes Digital and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last updated" date and, where appropriate, notifying you via email or in-app notification. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

12. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of the Netherlands.

For consumers within the European Union, this does not affect your mandatory consumer protection rights under the laws of your country of residence.

13. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.
