Terms of Service — DateGuard

1. Acceptance of Terms

By downloading, accessing, or using DateGuard ("the App"), operated by Heijnes Digital ("Company", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use DateGuard. These terms apply to all users of the App.

2. Description of Service

DateGuard is an AI-powered dating safety application that analyzes dating profile screenshots and conversation text to detect potential romance scams, catfishing attempts, manipulation tactics, and other red flags. The App provides risk assessments and recommendations to help users make more informed decisions about their dating interactions.

3. User Accounts and Eligibility

You must be at least 18 years of age to use DateGuard. By creating an account, you confirm that you are 18 or older. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information when creating an account.

4. Subscriptions and Payments

DateGuard offers both free and premium features. Premium subscriptions are available through the Apple App Store and/or Stripe. Subscription fees are billed in advance on a recurring basis. You can cancel your subscription at any time through your App Store settings or account settings. Refund policies are subject to the terms of the Apple App Store or Stripe, as applicable.

You agree to use DateGuard only for legitimate personal safety purposes. Specifically:

• Only scan content where you have a reasonable and genuine interest in your personal safety
• Do not use DateGuard to harass, stalk, intimidate, or investigate individuals without legitimate safety concerns
• Do not upload content that you do not have the right to analyze
• Do not use scan results to defame, publicly shame, or harm others

7. Accuracy Disclaimer

AI analysis is probabilistic, not definitive. A "safe" or "low risk" score does not guarantee that a person is trustworthy, honest, or safe to meet. A "risky" or "high risk" score does not prove that a person has malicious intent or is a scammer. Risk scores are based on pattern recognition and should be treated as one data point among many in your personal safety assessment.

8. Acceptable Use

You agree not to:

• Reverse engineer, decompile, or disassemble the App or its AI analysis systems
• Use automated systems, bots, or scripts to perform bulk scanning
• Use DateGuard's analysis results for any commercial purpose
• Attempt to gain unauthorized access to our systems or other users' data
• Interfere with or disrupt the proper functioning of the App
• Use the App for any unlawful purpose or in violation of these terms
• Resell, redistribute, or sublicense access to DateGuard

9. Intellectual Property

All content, features, and functionality of DateGuard, including but not limited to text, graphics, logos, icons, images, AI models, algorithms, and software, are the property of Heijnes Digital and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our explicit written permission.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Heijnes Digital shall NOT be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Physical, emotional, or financial harm resulting from reliance on DateGuard's analysis
• Harm resulting from the failure of DateGuard to identify a genuine threat or scam
• Harm resulting from a false positive that incorrectly flagged a safe individual
• Loss of profits, data, use, goodwill, or other intangible losses
• Any damages arising from unauthorized access to your account

You acknowledge that dating safety inherently involves risk and that no technology can eliminate that risk entirely. You use DateGuard at your own discretion and risk.

11. Indemnification

You agree to indemnify, defend, and hold harmless Heijnes Digital, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of DateGuard, your violation of these terms, or your violation of any rights of another party.

12. Termination

We reserve the right to suspend or terminate your account at any time if you violate these terms or engage in prohibited activities. Upon termination, your right to use DateGuard ceases immediately. Sections regarding limitation of liability, indemnification, and governing law survive termination.

13. Governing Law

These terms are governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from these terms or the use of DateGuard shall be subject to the exclusive jurisdiction of the courts in the Netherlands.

14. Changes to Terms

We reserve the right to modify these terms at any time. We will provide notice of material changes through the App or by email. Your continued use of DateGuard after changes are posted constitutes acceptance of the modified terms.
