Terms of Service — DailyDuel

1. Acceptance of Terms

By downloading, installing, or using DailyDuel ("the App"), operated by Heijnes Digital ("Company", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.

2. Description of Service

DailyDuel is a "Human vs AI" daily challenge app. Users are presented with content and must vote on whether it was created by a human or generated by artificial intelligence. Users can also submit their own content for challenges, earn points, maintain streaks, and compete on leaderboards. We reserve the right to modify, suspend, or discontinue any part of the service at any time.

3. User Accounts

To use DailyDuel, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information when creating an account. You must be at least 16 years old to create an account.

4. Subscriptions and Payments

DailyDuel may offer premium features through paid subscriptions. Payments are processed through the Apple App Store or Stripe. Subscription renewals occur automatically unless cancelled before the renewal date. Refund policies are subject to the respective payment platform's terms. Prices may change with reasonable notice.

5. User Submissions

By submitting content (text, images, or other media) to DailyDuel challenges, you:

  • Grant Heijnes Digital a non-exclusive, worldwide, royalty-free license to display, distribute, and use that content within the App for challenge and voting purposes
  • Retain full ownership of your original content
  • Confirm that the content is original or that you have the proper license or rights to submit it
  • Accept that submitted content may be shown to other users for voting
  • Understand that content in completed challenges may persist even after account deletion

6. Voting and Leaderboards

Fair play is expected from all users. You agree not to:

  • Manipulate votes or scores through any means
  • Use automated tools, bots, or scripts to vote
  • Collude with other users to influence challenge outcomes
  • Create multiple accounts to gain an unfair advantage
  • Exploit bugs or glitches to inflate scores or streaks

We reserve the right to remove, reset, or ban accounts that violate fair play policies.

7. Content Guidelines

Content submitted to DailyDuel must not include:

  • Offensive, hateful, or discriminatory material
  • Illegal content or content promoting illegal activities
  • NSFW (Not Safe For Work), sexually explicit, or graphic violent content
  • Content that infringes on intellectual property rights of others
  • Spam, misleading, or deceptive content
  • Personal information of third parties without consent

We reserve the right to remove any content that violates these guidelines and to suspend or terminate accounts of repeat offenders.

8. AI Content Disclaimer

AI-generated content displayed within DailyDuel challenges is provided for entertainment and educational purposes only. The AI content is pre-generated and does not reflect the views or opinions of Heijnes Digital. We make no representations about the accuracy, completeness, or appropriateness of AI-generated content.

9. Acceptable Use

You agree not to:

  • Use DailyDuel for any unlawful purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with the proper functioning of the App
  • Reverse engineer, decompile, or disassemble the application
  • Use automated systems to access the service without permission
  • Harass, abuse, or harm other users
  • Impersonate another person or misrepresent your identity

10. Intellectual Property

All content, features, and functionality of DailyDuel, including but not limited to text, graphics, logos, icons, images, and software, are the property of Heijnes Digital and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our explicit written permission.

11. Limitation of Liability

To the maximum extent permitted by law, Heijnes Digital shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of DailyDuel. The App is provided "as is" without warranties of any kind.

12. Termination

We may terminate or suspend your account at any time if you violate these terms, engage in fraud or manipulation, or for any other reason at our sole discretion. Upon termination, your right to use the App ceases immediately. You may delete your account at any time through the App settings.

13. Governing Law

These terms are governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from these terms or the use of DailyDuel shall be subject to the exclusive jurisdiction of the courts in the Netherlands.

14. Changes to Terms

We reserve the right to modify these terms at any time. We will provide notice of material changes through the App or by email. Your continued use of DailyDuel after changes are posted constitutes acceptance of the modified terms.
